In general, after registering each notification in the notification system of the judiciary, an SMS is sent to the addressee. In this SMS, he is asked to read his notification within a certain period of time. Then, after being aware of the complaint and being informed of the content of the notification, he should take the necessary actions on it. In the following, we will examine the details of this process further.

How to report a complaint

During the process of notifying about the complaint, there is an important point that the defendant himself is placed in this process by being informed of the complaint against him. This is due to the fact that the plaintiff has the personal information and identification of the accused and has filed a complaint against the accused using this information.

In other words, in this case, the complaint was not filed in absentia. If the complaint is absent, the accused person can easily refer to the Sana system and get information about the complaint and its details. In the following, after examining the steps related to the notification of the complaint, we will also refer to the investigation of the absence complaint inquiry.

Complaint notification procedures

There are two ways to report a complaint:

۱٫ Direct reference to the judicial electronic services office:
In this method, we refer to the nearest judicial service office. We register in the electronic registration system for the delivery of judicial documents by providing the national card and identity card information, address, phone number and postal code and receiving an electronic signature from the office. Then we can file a lawsuit or get information about lawsuits against us.

۲٫ Pre-registration in the Sana system (at home) and then visit the judicial service office or the judicial complex to confirm the registration:
In this method, we first pre-register in the Sana system and then go to the judicial services office or the judicial complex to confirm the registration and receive information about the complaint.

Regarding the second stage, i.e. pre-registration in the Sana system through home and then going to the judicial services office, we must go through the following steps:

۱٫ Login to Sana system.
۲٫ If we are a natural person, we click on the natural person registration option.
۳٫ We enter our personal information, including national code, date of birth and birth certificate serial number.
۴٫ At the end of the steps, we click on the button to finish registering the basic information.
۵٫ Then, we go to the electronic judicial services office to authenticate and receive the signature, along with the national card and the mobile number that we entered during registration.

Sana system to inform about the complaint

The Sana system is one of the sub-systems of the judiciary that provides comprehensive and complete services related to judicial complaints. By visiting and registering in the Sana system and authenticating in this system, people can know the details of the complaint filed against them. In addition, this system also provides other facilities:

۱٫ Information about the complaint: People can see the full details of the complaint filed against them in this system and learn about the process of following up and handling their complaint.

۲٫ Viewing the work process of the case: By using the Sana system, people can see the complete work process of their case. This includes the scheduling of proceedings by the court as well as the progress of the case in various judicial stages.

۳٫ Viewing judicial notices: Through the Sana system, people can view judicial notices related to their case. These notifications include notices, petitions and judicial notices.

۴٫ Viewing the court decision: If the court issues a decision or verdict in the case, people can easily view their court decision through the Sana system.

By using the Sana system, people will be able to easily and quickly be informed about the status of the complaint, the process of the case and the related judicial decisions.

Notification of absence complaint

In this section, in order to complete the text, we will examine the information related to the absence complaint. Complaining in absentia means filing a complaint against a person whom the complainant does not know well. In other words, the person being sued is unaccounted for and therefore the plaintiff has to file a complaint in absentia. Referring to Articles 175 and 176 of the Criminal Procedure Law and drafting a regulation called “Regulations on how to use computer and telecommunication systems”, it is possible to inform about absentee complaints as follows:

If the addressee is unknown and there is no access to his user account, the notification of judicial documents is done by publishing an advertisement in the system and in one of the widely circulated newspapers. In this case, the person who is sued for absenteeism is required to register and get his user account to be notified of the absentee complaint against him.

In addition, a system called “Electronic Judicial Notice System” has been established under the Iranian Justice System. People who want to know whether a complaint has been filed against them in absentia can inquire about their complaints using the electronic advertisement system instead of referring to widely circulated newspapers. If they see that an absentee complaint has been filed against them, they should register in the Sana system and then view the details of the absentee complaint.

By using the Sana system, people will be able to easily and quickly find out about the status of the absence complaint against them and its details.
